Clemens brings suit against McNamee for defamation
After all the talk, apparently Roger Clemens will sue his former trainer Brian McNamee for defamation. Bloomberg reports this story:
Jan. 7 (Bloomberg) -- Roger Clemens, a seven-time winner of baseball's Cy Young award, sued former trainer Brian McNamee for defamation over allegations he used steroids and human growth hormones.
The lawsuit, filed in state court in Harris County, Texas, says McNamee falsely told investigators that he injected Clemens with the banned substances on multiple occasions dating back to 1998.
Clemens, 45, was among the more than 80 baseball players accused of using performance-enhancing drugs in a report by former U.S. Senator George Mitchell last month. In an interview with CBS Corp.'s ``60 Minutes'' broadcast yesterday, Clemens said that while he didn't receive steroid or HGH injections from McNamee, he did receive pain-killers and vitamin B-12.
``McNamee made the allegations with actual malice, knowing they were false,'' Clemens lawyer Rusty Hardin said in the complaint sent to Bloomberg News in an e-mail today by Joe Householder, a spokesman for Hardin. ``They injured Clemens' reputation and exposed him to public hate, contempt, ridicule and financial injury.''
Richard Emery, McNamee's New York-based lawyer, didn't respond to phone and e-mailed requests for comment left today before working hours. The Associated Press reported that the lawsuit was filed last night.
Yesterday, during the 60 Minutes interview Clemens seemed to be dismissive of suing. Not very articulate at that point, Clemens seemed to be saying that he was advised to sue, and that this would draw down on his bank account.
CLEMENS And that's our country, isn't it? Guilty before innocent. That's the way our country works now. And then everybody's talking about sue, sue sue. Should I sue? Well, let me exhaust. Let me, let me just spend. How about, let's keep spending. But I'm gonna explore what I can do and then I want to see if it's gonna be worth it, worth all the headache.
